1.       Acceptance of the Terms of Service

      1.1       These Terms of Service are entered into by and between you and Timio News LLC (“Company,” “we,” “our,” or “us”). The following Terms of Service (“Terms”) govern your access to and use of both the TIMIO News Google Chrome Extension, Mobile Application (available on both Google Play and IOS), and website, including any content, functionality, and services offered on or through Timio News’s Google Chrome Extension and/or Application (“TIMIO News”), and/or Website (timio.news) whether as a guest or registered user.
1.2       Please read the Terms of Services carefully before you start to use Timio News. By using Timio News or by clicking to accept or agree to the Terms of Services when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at [http://www.timio.news/privacy]. If you do not agree to these Terms or the Privacy Policy, you must not access or use Timio News.

2.       Changes to the Terms of Service

      2.1       We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately upon posting to Timio News and apply to all access to and use of the services thereafter. Your continued use of Timio News following the posting of revised Terms of Service means that you accept and agree to the changes to the Terms.
      2.2       We reserve the right to amend these Terms at any time. Any amendments or updates will be effective immediately upon posting to Timio News. It is your responsibility to regularly check Timio News for any changes to the Terms.

3.       Intellectual Property Rights
      3.1       Unauthorized use, replication, or copying of any part of Timio News, including its name, image, code, or any other intellectual property, is strictly prohibited and may result in legal action.
      3.2       All rights outside of news articles and third-party websites or tools, including copyright, patents, trademarks, trade names, designs, and any other form of intellectual property rights (including “Pivot” and “Torch”, Timio News’s AI features) are owned by or licensed to us.
      3.3       While the application facilitates access to third-party content, the intellectual property rights of such content remain with the original copyright holders.

4.       License to Use. We grant you a personal, non-exclusive, non-transferable, and revocable license to use Timio News for personal, non-commercial purposes only.

5.       Restrictions
      5.1       You may not reverse engineer, decompile, or disassemble any part of Timio News.
      5.2       You may not use Timio News for any purpose that is illegal or prohibited by these Terms.
      5.3       You may not use Timio News in a way that could damage, disable, overburden, or impair any Timio News servers or networks.
      5.4       You are prohibited from using Timio News, or any of its features to violate copyright law or intellectual property.
      5.5       You are prohibited from using Timio News to interfere with or circumvent the security features of the application, or any RSS feed, website,                         publisher you access through Timio.
      5.6       You agree that you use Timio News at your own risk, and if you violate any of these restrictions, you will be responsible for any legal ramifications.
      5.7       You are forbidden from using “Reader View”1 to access locked 3rd party content, or violate 3rd party terms of service. Should you choose to use a reader view on paywalled content, you are required to sign in to the service you are accessing. Failure to comply may lead to termination of your Timio News account.
      5.8       You may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from Timio News.
      5.9       You agree not to use Timio News in any way that violates any applicable federal, state, local, or international law or regulation, or to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Timio News, or which, as determined by us, may harm Timio News or users of Timio News or expose them to liability.

6.       Termination.

      6.1       We reserve the right to terminate or suspend your access to Timio News without prior notice if you breach any of these Terms.
      6.2       If a user repeatedly infringes on intellectual property rights or copyrights, Timio News may terminate the user’s access to Timio News.

7.       Information About You and Your Visits to Timio News. All information we collect on Timio News is subject to our Privacy Policy. By using Timio News, you consent to all actions taken by us with respect to your information in compliance with the Privacy Policy.

8.       Disclaimer
      8.1       Timio News is provided “as is” and makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of Timio News.
      8.2       You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or Timio News will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE OR YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY WEBSITE LINKED TO IT.
      8.3       YOUR USE OF TIMIO NEWS, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH TIMIO NEWS IS AT YOUR OWN RISK. TIMIO NEWS, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH US ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE WEBSITETIMIIO NEWS. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT TIMIO NEWS, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE, APP OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT TIMIO NEWS OR ANY SERVICES OR ITEMS OBTAINED THROUGH TIMIO NEWS WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS. 
      8.4       TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
      8.5       THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

9.       Statements made by AI
      9.1       Natural Language Processing AI2 often makes mistakes, such as “hallucinations.” Since Timio News uses AI, the output should never be taken                   at face value.
      9.2       All content, recommendations, or interpretations, by our AI are intended as opinions. You should not treat any statements by our AI as factual.
      9.3       Content, recommendations, or interpretations, made by our AI are intended to encourage you to do further research and in no way claim to be truthful or factual.
      9.4       You agree that you will not hold us liable for any damages related to incorrect or false statements from our AI.
      9.5       If you believe the AI is making false statements about you or your organization, please contact us through our website.

10. Copyright and DMCA
      10.1       If you believe that material accessible in or linked to by Timio News violates your copyright, you are encouraged to notify us in accordance with the Digital Millennium Copyright Act (“DMCA”) Policy. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. You may also simply email us before sending an official DMCA takedown request, and we will investigate the matter. Takedown requests can typically be processed and completed in less than a week.
      10.2       Timio may terminate a user’s access to the application if, under appropriate circumstances, they are determined to be a repeat infringer of copyrights or other intellectual property rights.

      11.       Indemnification. You agree to indemnify and hold us harmless from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

      12.       Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America.

1.     ‘Reader View’ is a Timio News feature that simplifies articles into a text-only format, eliminating ads and excessive formatting. Articles default to a standard web view but can be manually switched to “Reader View” by swiping or using the toggle feature above the article.
2.      For the purposes of these Terms, “AI” (Artificial Intelligence) refers to any system, software, or technology that utilizes algorithms, machine learning, neural networks, natural language processing, or other similar methods to perform tasks, make decisions, or simulate human cognitive functions. This includes, but is not limited to, automated systems that can analyze data, generate content, interact with users, or perform specific tasks based on input or predefined criteria without human intervention.
